GOSHEN — An Elkhart County judge will preside over a wrongful death lawsuit against Noble County, filed by the relatives of a man and his daughters who died in February 2019 after plunging into the Elkhart River.

Jesus Reyes, 50, of Ligonier, died Feb. 11, 2019, after losing control of his vehicle on the snow-covered curve at C.R. 700 West and Ball Road and entering the river. Also in the vehicle were daughters Zulia Reyes, 15, and Valeria Reyes, 13.

joe! I know you never let facts get in your way! First fact! No speed limit signs. Second fact! No prior warning of an up coming severe turn! Third just an arrow at the immediate westward turn. Fourth fact! As you travel westerly on Ball rd. to Rochester rd there are 2 curve arrows posted well before the curves. 5 fact! the return eastward side of Ball rd has "3" curve signs before the intersection with 700 west. 6th fact joe there is actually a 30MPH speed limit on the eastward side of Ball rd. 7th fact! No speed signs on the westward side of Ball rd. And of course you are correct. There probably wasn't any corn. Maybe!

Your leaving out 2 of the most important things....Common Sense and Driving at a safe speed for current weather conditions. You may be allowed to drive 50 mph, but you don't if it is raining, snowing, or icy...He was driving too fast for current road conditions that caused him to loose control. There are yellow curve signs up, it pretty obvious the road curves...either way you drive it...And, given the fact there was no crops planted, you can see the road in advance....Sorry, but the government can't hold your hand all the time. And driving in the winter, in a northern climate, as an adult, you are aware of snow and ice on the road...duh...I'm telling you this?

Not quite as uncaring as Joe. Certainly personal responsibility is utmost. Just wondering if joe and Fly feel the same about the Mishawaka mom and her childrens death!

I do. Driving too fast for road conditions is not the fault of someone else. We live in the north. it rains, it snows and we get ice...kids may inexperienced drivers, but adults certainly are not.

So going to Google Earth, here is what I found. There are no road signs on CR700 West showing a 90degree turn until you are at the turn. There are no signs or guardrails at the turn declaring a river or body of water! the police said speed was a factor. Hmmm....There are no speed limit signs. A rural road in Indiana if not posted is 50 MPH. You would think a road with a 90 degree turn would have "some" warning sign a distance before the turn. Nope! Not here! Coupled with the fact CR 700 West is a very narrow, very rural road and not posted with informative signage, this case will not go to court. The county will be happy to settle out of court!

Street view showing arrow that it curves, also, since it was winter, there was no corn so you can see the curve to the right. The road is narrow, how slow should if have been going? in the winter? With icy conditions? Some measurement of responsibility should be on the driver. The road looks like it has been maintained, especially for a rural road. Street view doesn't go any further so I don't know if there were advance warnings...Its a rural road, so obviously he knew about it and was traveling on it...this isn't some stranger lost in the country....Frivolous...
