GOSHEN — An Elkhart man who admitted to raping a girl when he was 16 received a 15-year sentence Thursday.
Bailey McDonald, 21, pleaded guilty to rape as a Class B felony just days before a scheduled jury trial in January. He was originally charged with the crime as a Class A felony in the warrant for his arrest, which was issued in February 2018.
His arrest was ordered following an investigation by the Elkhart County Sheriff’s Office into accusations a woman brought forward in November 2017. The victim, who was under 14 at the time, told investigators about several incidents involving McDonald, including the one in November 2013 that he was charged with.
She said he threatened to kill her or her mother if she told anyone.
His sentencing in Elkhart County Superior Court 3 had been postponed until Thursday. Under the terms of his plea, he will serve four years in the Indiana Department of Corrections followed by five years on a Michiana Community Corrections program and six years on probation.
He was also ordered to pay restitution to cover the cost of any counseling the victim may have had to undergo.
A Class A felony carries a punishment of up to 50 years in prison while a Class B felony is punishable by up to 20 years. He was charged and sentenced under the state laws for felony levels that were in effect in 2013.
