MIAMI (AP) — An Indiana man charged with negligent homicide in his young granddaughter's fatal fall from a cruise ship's open window in Puerto Rico leaned out of that window for several seconds before he lifted the child up to it and she fell, the cruise operator alleges in a court filing.

Royal Caribbean Cruises' Jan. 8 filing in U.S. District Court in Miami comes in response to a lawsuit the parents of Chloe Wiegand filed in December, accusing the operator of negligence in her death by allowing an 11th floor window in the ship's children's play area to be open.

Gosh! I can't imagine what could be accomplished by charging this grandfather with negligent homicide. First of all you would need to prove the negligence of the person that supposedly caused a death! The negligence I saw was that a window was open 100' off the ground. The railing is situated inside the window about a foot! And some people might believe a grainy off color blurry video taken from a distance is terrific evidence. Good thing I'm not on the jury if grandpa chooses a jury trial!

Because, if this is all the proof the prosecutor has, I would vote not guilty. Some people might believe the cruise company is negligent. That's me! Window should be able to be opened that high off the ground. Most falls on concrete above a third floor are fatal! According to the family attorney no signage was used, the windows should have been locked, and netting or opaque mesh used. So in a civil trial only a majority of the jury need find the defendant "guilty". And what does being a cop have to do with the case. Police don't bring charges nor do they decide who may be guilty! Strange how some people think!

Joe, where do you come up with this rot! The criminal case will require a unanimous verdict of guilty from 12 jurors. The civil case against the cruise line will require a majority decision. And Joe your reasoning from your other post would NEVER stand in court! Just because something may have or may not have happened has no bearing in law. And have you seen the ORIGINAL? And are you implying the one seen on most websites is a fake? Dig your hole Joe! Kind of like that rich people killing those poor people on Beardsley! Remember...unanimous verdict to convict the grandfather! Majority count to get a suit awarded!

Fire, the video and facts are clear. Only your bias or bad eyesight is blocking you from the truth..but that is to be expected since you left the gop party for the party of trump...facts don’t matter? Alternative facts you see? His defense so far? I dint know the window was open. Then it became i am colorblind so I couldn’t tell it was open...and now it has morphed to it should have been allowed to open in the first place. Now for the facts and what the video shows...he leans out the window by himself first and looks around...Then, he picks the child up and out the window for 34 seconds...then looses grip..if it was me, I would be terrified and would be trying to get back in..he lost his grip and drops her. Those are the facts. This was all him. Not the ships fault, not the windows fault..the grandpa. Where’s the justice for the toddler? And no, the video isn’t fake. Facts matter.

grandpa should be charged! Parents should be embarrassed for bringing a lawsuit and trying to blame others...he's even a cop! They need to look in the mirror before blaming others. The facts and video doesn't lie.... Grandpa was 100% at fault. Glad the Cruise line is defending itself.

Hey fire, they had enough time to get an attorney within 24 hours and announce a lawsuit within what 72 hours? Their story and the video doesn’t match, now they said he didn’t know because he was color blind.. give me a brake...there has NEVER been a case a toddler fell out of a window on a ship. Never. Until he decided to lift her up and out for over 30 seconds...who does that? This was not an accident...he lifter her up....and I thought you were pro life? Justice is deserved for the toddler.

This is so sad. If the video exists that shows the grandfather acting as described then I agree he should be charged. However if he is a police officer or not is irrelevant.

the father is an officer not the grandfather. Joe has trouble sometimes verbalizing or printing the truth of a matter!
