Goshen Hospital

GOSHEN — More parties have joined a lawsuit against Goshen Hospital over potential infectious exposure, but the judge has not yet ruled on class action status.

A lawsuit filed in November on behalf of Linda Gierek and her husband, Frank, claims she was one of over 1,000 patients who were told they could have been exposed to infectious diseases during surgery. The suit sought class certification for both patients and spouses of patients who underwent procedures between April and September.

The game of Liability Lotto is continuing. I understand the dread of catching a supposedly incurable disease. But if the hospital is willing to allow independent testing for these diseases at their own expense, what is lost? If the individuals test positive for any of the diseases then there are grounds for a lawsuit. But if no disease is found, then what harm has actually been done? Ah, yes. We've had to worry. And we should be well paid for that worry. Liability Lotto in full swing.
