ELKHART — A judge will decide by February whether a claim against the city of Elkhart over a deadly hit-and-run accident will go to trial or be dismissed.

The city faces a negligence lawsuit brought on by survivors of an accident on East Beardsley Avenue in February 2019 and the families of three people who were killed. An adult man and two girls were killed when a vehicle driven by Leonard Grosswiler left the roadway and struck a group of five people on the sidewalk.
