Last Toledo abortion clinic appeals closing order; license will be revoked next week

TOLEDO, Ohio (AP) — Toledo’s last abortion clinic is turning to the courts to try to stay open.

The Blade newspaper (http://bit.ly/XLxUf7 ) reports that the Capital Care Network filed documents this week asking the court to overturn the Ohio Department of Health’s decision that it must close. Its license is scheduled to be revoked on Tuesday.

The state’s decision last month followed a hearing officer’s recommendation that the clinic should be closed because it lacks a valid emergency-care agreement with a “local” hospital.

The clinic has argued that an agreement with a hospital more than 50 miles away, in Ann Arbor, Michigan, puts it in compliance with a new Ohio law that requires the transfer agreement. State officials disagreed.
