Lawsuit disputes plan for public access boat ramp on Eagle Lake

Residents are seeking to overturn a decision to allow a public access boat ramp.

EDWARDSBURG, Mich. — Eagle Lake residents are suing the government over a proposal to place a public access boat ramp on a disputed parcel of land.

The lawsuit filed Wednesday, March 19, names the Ontwa Township Zoning Board of Appeals, Ontwa Township and the Michigan Department of Natural Resources as defendants. It was filed by Grand Rapids law firm Bloom, Sluggett and Morgan on behalf of the Eagle Lake Improvement Association, the Eagle Lake Dock, LLC, Michael Mrocezk and Glen Neely.

Specifically, the lawsuit calls into question a Feb. 25 decision by the Ontwa Township Zoning Board of Appeals "does not comply with the constitution and laws of the state, is not based on proper procedure, is not supported by competent material and substantial evidence on record and does not represent reasonable exercise of discretion granted by law to the zoning board of appeals."

The plaintiffs are asking for a reversal of the Feb. 25 decision by the zoning board of appeals.
