A Mishawaka man has been arrested on charges of child molestation for allegedly abusing a female relative when she was 5 years old.
David Earl Hamilton, 75, was arrested on a warrant for child molesting, a class A felony, on Monday, Aug. 11.
According to court documents filed in the case, the victim’s mother contacted police on Dec. 18, 2013, and reported that the victim told her she’d been abused by Hamilton when she was 5 or 6 years old.
A forensic interviewer with the Elkhart County Child and Family Advocacy Center met with the victim, now 11, on Dec. 23.
The victim described three incidents to the interviewer which occurred in her bed at her home in Elkhart County, in the basement of her home and at Hamilton’s home in Mishawaka.
She told the interviewer that Hamilton had pulled down her pants and performed oral sex on her. He then made her perform oral sex on him, according to the affidavit.
Detectives from the Elkhart County Sheriff’s Department also interviewed Hamilton’s ex-wife, who gave descriptions of Hamilton’s body consistent with details the victim told the interviewer.
The Elkhart County Prosecutor’s Office filed the formal charge against Hamilton on Aug. 4 and a warrant was issued for his arrest, according to court records.
He was booked at the Elkhart County Jail on Monday with a $100,000 bond. As of Tuesday, Hamilton was no longer listed as an inmate at the jail.
