The Millersburg town marshal is facing two criminal charges after he admitted to stealing panties belonging to his son’s girlfriend.
David Keith Hathaway, 59, was charged with two counts of conversion, a class A misdemeanor, on Wednesday, July 16, in Elkhart Superior Court 6, according to a news release from the Elkhart County Prosecutor’s Office.
A woman contacted Indiana State Police in February and said that in October 2013 she had found a pair of her panties in a gallon-sized bag along with several other pairs of panties she did not recognize hidden in a safe belonging to Hathaway, who is her boyfriend’s father, according to court documents filed in the case.
The woman and her boyfriend live with Hathaway, according to police.
The couple confronted Hathaway about the stolen underwear and he claimed it was a joke. The woman found the panties that had been in the safe folded on her bed a few days later.
Several months later, on Feb. 18, 2014, she found a pair of her panties wet and crumpled up on the floor under her bed. She and her boyfriend then set up a hidden video camera in the room, the document states.
When they reviewed the video, they saw Hathaway enter the room and bend down to pick up a pair of her panties from the floor. He raised the panties to his face with both hands and inhaled before putting the panties back on the floor, picking up another pair and leaving the room.
Indiana State Police Det. Don Curl interviewed Hathaway in late May 2014 and Hathaway admitted to stealing and sniffing the panties.
Hathaway told police he has a panty fetish and is seeking help, according the document.
Hathaway is scheduled to appear for an initial hearing on the charges on Aug. 15 in Elkhart Superior Court 6, according to court records.
