Man will return to St. Joseph County to face charges in connection with 2-year-old's death

Xavier Primm, 23, who was involved in a shootout between rival groups, is charged with assisting a criminal.

SOUTH BEND — One of the people accused of killing a 2-year-old in South Bend has waived extradition proceedings in Illinois and will return to St. Joseph County.

Xavier Primm, 23, has been charged with assisting a criminal, a Class C felony, according to a press release from the St. Joseph County Prosecutor's Office.

Since Primm has agreed to come to St. Joseph County, the prosecutor's office does not have to obtain a governor's warrant.

Once Primm returns, he will be arraigned, according to the release. A hearing time and date will be announced at a later time.

John Swoveland Jr. was killed by a stray bullet during a shootout between two rival groups, according to The Elkhart Truth's news partner, WNDU.
