Same-sex marriage licenses being issued in Elkhart County

Elkhart County Clerk’s Offices have issued two same-sex marriage licenses, county clerk said.

Elkhart County is issuing marriage licenses for same-sex couples. 

Wendy Hudson, Elkhart county clerk, said the office of the attorney general has issued an opinion on a federal judge's same-sex marriage ruling. In it, it states that the Attorney General’s office will contact county clerks of court on “proper marriage license procedures they should follow in order to avoid chaos during the appeal.”

It further states that the office plans to file an appeal to the decision and ask for a stay. 

Elkhart County Clerk Wendy Hudson said her office received the Attorney General’s office opinion late in the day.

“My staff are prepared,” she said. “We're more than happy to do it until we hear otherwise.”

Elkhart County Clerk’s Offices have issued two same-sex marriage licenses. One in Superior Court 3 and one in Superior Court 1, Elkhart, Hudson said.

Hudson said the clerk’s office received multiple calls throughout the day from people asking whether Elkhart County was issuing same-sex marriage licenses.

“We just wanted to make sure that we were doing it to the best of our ability,” Hudson said. “And to protect the people that are applying we want to make sure that it is authorized rather than having to immediately invalidate something.”

St. Joseph County issued 19 marriage licenses to same-sex couples Wednesday, according to a tweet from South Bend Tribune reporter Amanda Gray.

Elkhart County courts will be open tomorrow from 8 a.m. to 4 p.m. Elkhart Superior Courts 1, 2 and 3 issue marriage licenses.
