ELKHART — The June 6 shooting of Latyris Mitchell was an act of revenge, according to witnesses.
In a probable cause affidavit filed in Elkhart Superior Court 1 on Tuesday, July 2, a witness alleges he heard Jacques Allen, 18, of Elkhart, say, “N-----, you’ve been shooting at my homies!” before shooting Mitchell three times in the abdomen.
According to the affidavit, Mitchell told police he rode his bicycle to Stop-And-Go in the 200 block of East Indiana Avenue on Thursday, June 6, to purchase tobacco products. He saw Allen standing outside the store with several other black males. Mitchell said Allen said something to him but did not remember what Allen said. He saw Allen pointing a handgun at his abdomen and then Allen shot him several times.
Mitchell told police he “didn’t want to die there” and ran to his home on Frances Street. His mother called the police.
Two other witnesses, one who was standing with Allen at the time of the shooting and an employee of a nearby business, identified Allen as the shooter from a photo array.
The incident was also recorded on a security camera located at Puff’s Smoke Shop, 208 E. Indiana Ave.
Police searched Allen’s last known address on June 13 and found a bullet under Allen’s bed matching the bullets and casings found at the scene.
Allen was arrested on Sunday, June 30, after a woman called police to report two black males standing in a yard. She said one of the males appeared to be holding a gun.
The responding officers found the subject matching the caller’s description of the male with the gun and began to speak with him.
The subject provided a false name, Myron McKnight, and when the officer recognized him as Jacques Allen, he fled on foot.
The officers chased him, yelling, “Stop, police!” numerous times. Allen was almost struck by a car during the chase and the officers caught up with him as he attempted to enter an apartment at 319 Chapman Ave.
He faces charges of attempted murder and resisting law enforcement. His initial court hearing is scheduled for 8:30 a.m. Thursday, July 11, in Elkhart Circuit Court.
