Elkhart man sentenced to 23 years in jail for toddlers death

The Goshen News reports that Daniel Pennington was not present in court for his sentencing on Thursday.
Gibson died on May 16, 2011, after falling out of a car driven by Pennington. Gibsonís mother, Mande Turner-Berger, was also in the vehicle at the time and initially told police Gibsonís vehicle had been struck by a driver who fled the scene.
Turner-Berger accepted a plea deal in August 2011. She pleaded guilty to neglect of a dependent and obstruction of justice, and was sentenced to five years in prison. She also received 10 years probation.
In her plea, Turner-Berger admitted that 19-month-old Gibson was wearing a seatbelt in the backseat of the vehicle but was not in a child safety seat. She also said she and Pennington had ingested marijuana before the accident.
