According to a press release from the St. Joseph County Prosecutor’s Office, Joseph Wayer, III’s trial in St. Joseph Superior Court 8 has been continued. An attorney status hearing has been set for April 22, when the court anticipates a new attorney will appear on Wayer’s behalf. The court will also use that hearing to re-schedule Wayer’s trial.
Wayer was charged with murder Feb. 15, 2012, in the death of Barbara Sheppard, whose body was found Dec. 22, 2011, in an alley near Low Bob’s Discount Tobacco at Lincolnway and Byrkit in Mishawaka, where she worked.
Sheppard suffered a sharp-instrument injury to her neck, said police. Sheppard’s body was found nine days after her divorce with Wayer was finalized.
In an interview with police, Wayer admitted he had posted comments online and confirmed he was upset with Sheppard but said he would never harm her. DNA evidence collected from Sheppard’s hand during the autopsy indicated the possibility of it matching Wayer’s, according to the probable cause affidavit filed in his case.
Wayer’s trial has been continued several times since June. He faces up to 65 years in prison.
