Accident at Hively and Sterling Avenues under investigation

ELKHART — Two men who were taken to the hospital from an accident on Tuesday have been released, but the accident remains under investigation.

The Elkhart Police and Fire departments were called to the intersection of Hively and Sterling avenues around 11:46 a.m. Tuesday for a two-vehicle accident.

According to the accident report, witnesses at the scene told police that a silver passenger car driving south on Sterling Avenue collided with a black pickup truck that was driving west on Hively Avenue. Witnesses said the passenger vehicle was going over the speed limit for Sterling Avenue. One of the witnesses estimated the car could have been traveling at about 60 to 70 mph.

Upon arriving at the scene police saw both cars had extensive damage. They found the driver of the pickup truck, Eusebio Chavez, outside the vehicle complaining of pain to his stomach and legs.

Chavez told police he had just turned west onto Hively from C.R. 45, and he was about to turn north onto Sterling Avenue when the other vehicle collided with his truck. The crash sent the pickup truck spinning south across Hively, striking a utility pole.

The driver of the passenger car, Timothy Dubie, was found inside the vehicle semiconscious and bleeding from his mouth. He was wearing a seatbelt. The car had extensive damage to the front. Dubie had to be extricated from the vehicle.

First responders told police they could smell an odor of what they believed to be an alcoholic beverage from Dubie’s breath as they worked to extricate him.

A driver’s license check showed Dubie’s license was suspended for a prior conviction.

Both men were taken to Elkhart General Hospital, where they were treated and released. According to the accident report, Dubie was taken to the hospital with injuries to the head. Alcohol and drug tests were administered to both drivers but results are pending, according to the accident report.
