Goshen man sentenced on meth, shooting charges

GOSHEN — A Goshen man who pleaded guilty dealing in methamphetamine within 1,000 feet of a youth complex, burglary and criminal recklessness was sentenced Thursday in Elkhart Circuit Court.

Danny Mason, 22, of 401 Middlebury St., was sentenced to 35 years in prison, with eight of those years suspended and on probation.

During his plea hearing on Jan. 4, Mason admitted he broke into a private property to manufacture methamphetamine on March 9, 2012. He also admitted he performed a reckless act that could have caused bodily injury to another individual.

Mason was in a vehicle March 5, 2012, with Michael S. Smith, who drove to the residence of a woman and shot once in her and two other people’s direction before driving off. Mason had handed a handgun to Smith, who shot in the direction of the victims.

Smith pleaded guilty to unlawful possession of a firearm by a serious violent felon and criminal recklessness. He was sentenced Sept. 5, 2012, to 12 years in prison.

Deputy prosecutor David Francisco made a motion to destroy the firearm used in the March 5 incident. The motion was granted by Judge Terry Shewmaker.

During the sentencing hearing, Shewmaker recommended addictions treatment upon request of Mason’s attorney, Clifford Williams.

The judge also pointed out to Mason the lengthy criminal conduct he has had and called for him to change.

“You can spend the rest of your life in prison or you can turn your life around,” he said. “I can’t decide for you.”
