Indiana AG submits complaint in fungal meningitis outbreak

INDIANAPOLIS — Indiana Attorney General Greg Zoeller filed a licensing complaint Wednesday against a Massachusetts drug manufacturer connected to a 19-state fungal meningitis outbreak that has killed more than 670 people nationwide, including three from Elkhart County.

The Indiana Board of Pharmacy voted in November to suspend the pharmacy license of the New England Compounding Center to operate in the state. Zoeller said in a news release that the board will review the formal complaint at its next meeting on Feb. 11.

The drug manufacturer is linked to an infection outbreak that stemmed from tainted back pain medications that were distributed to 75 clinics in 23 states. Six clinics in Indiana, including OSMC Outpatient Surgery Center in Elkhart, received batches of the contaminated steroid medications. There have been 73 cases of fungal meningitis in Indiana, including nine deaths.

“The pharmacy failed to ensure its epidural steroid injections were safe for patients which led to devastating harm,” Zoeller said. “The formal licensing complaint against the New England Compounding Center will soon be considered by the Indiana Board of Pharmacy which has the authority to determine the appropriate discipline.”
