Elkhart man found guilty on two counts of child molesting

ELKHART — After a three-day trial, an Elkhart County Superior Court 3 jury found a man guilty on two counts of child molesting Friday.

Tim L. Hyser, 54, was found guilty on one count of child molesting, a Class A felony, and one count of child molesting, a Count C felony. The two charges are found under Indiana codes 35-42-4-3(a)(1) and 35-42-4-3(b). He faces a possible maximum sentence of 58 years in prison.

Deputy prosecuting attorney Jennifer Martin introduced evidence that Hyser had a child perform oral sex on him on several occasions while he was baby-sitting the child. The victim gave testimony that he fondled the child as well.

After the victim tried to stop Hyser by saying he or she had told their parents about the abuse, Hyser contacted the Department of Child Services, alleging the child was being abused by the child’s stepfather.

Detective Chuck Osterday of the Elkhart County Sheriff’s Department investigated the allegation and found no supporting evidence against the child’s stepfather. During the investigation, the child told Osterday about being sexually abused.

Hyser’s is scheduled to be senteenced at 9 a.m. Dec. 27 in Elkhart County Superior Court 3.

Additions and corrections: Hyser's middle initial is L. His cousin, Timothy C. Hyser, is a Goshen resident and is not accused of any crime.
