Elkhart man charged with promoting prostitution, conspiracy to commit murder appears in court

Jose Pena, 42, of 200 E. Indiana Ave. appeared for his initial hearing Thursday morning at Elkhart County Circuit Court. Pena was arrested Friday, Nov. 2, in connection to the shooting of a 30-year-old man earlier that day.

Pena has been charged with conspiracy to commit murder, a Class A felony, and promoting prostitution, a Class C felony. The judge entered a plea of not guilty for him at the time and appointed him a public defender.

According to the probable cause affidavit, Pena provided a gun to his co-defendant, Devarious Cantrell, 22, to shoot the victim.

The probable cause affidavit also states that Pena received money or other property from a prostitute.
