Democratic U.S. House hopeful’s TV ad comes under fire from GOP lawmakers

Two snippets of video in one of the TV ads of Democratic U.S. House candidate Brendan Mullen are drawing fire from three GOP state lawmakers.

The short video clips, including a segment of Walorski, depict activity at Indiana House chambers. In a letter to Mullen from Indiana Reps. Tim Neese of Elkhart, Tim Wesco of Osceola and Bill Friend of Macy, all Republicans, question whether the Democrat has permission from the Indiana Legislative Council to use the clips, as they say is required. They ask that he stop airing the ad in question.

Neese, a Walorski backer, said he was contacted by Walorski people about signing his name to the letter, actually researched by the Republican’s campaign. After looking into the matter himself, even seeking input from two lawyers on the validity of the accusations, he decided to assist, he said.

Mullen Campaign Manager Andy Reynolds rejected any suggestion the Democrat is doing anything wrong. The three GOP lawmakers maintain that rules prohibit use of video generated by the Indiana House “for a commercial purpose,” but Reynolds said Mullen’s use of it in a political ad doesn’t fit that classification.

“We’re comfortable that we’re well within our legal rights,” Reynolds said.

The 30-second ad, critical of Walorski’s support of 2006 legislation privatizing Indiana Toll Road management, is titled “Part of the Problem.” Each of the two video snippets in question, at the 14- and 17-second marks, run for perhaps two or three seconds. The first depicts hustle and bustle in the legislative chambers and the second shows Walorski speaking.
