ELKHART — Elisa Horton, who admitted to her involvement in the fatal shooting of John Staub, was sentenced Monday morning to four years in prison.

Horton, 22, pleaded guilty June 18 in Superior Court 2 to a felony charge of assisting a criminal when she drove Daniel Heflin, 21, William Terry, 25, and Dustin Saylor, 22, to 622 River Ave., and then picked them up and drove them away from the scene where Staub was shot and killed on March 22. Three others were injured that night, including a woman, David Paul Goble, 29, and Staub's brother, James Staub, 28.

Horton stated through her attorney that she did not know about the shooting when she picked up the other men.

However, chief deputy prosecutor Vicki Becker said although Horton was not aware of the incident, she provided the gun to Heflin, her boyfriend.

“That fact that she had a gun is curious, and the fact that she made it available to her boyfriend, given the context of what was going was the first very bad decision,” She said.

Driving the other three men to where Staub was, picking them up after an altercation, knowing that the men had thrown the ammunition out of the window of the vehicle and driving by the victims after the shooting were all a series of bad decisions, Becker said. But the worst decision was lying to police about what had happened.

“We absolutely cannot tolerate individuals who are part in a crime and mislead police officers,” she said.

Becker brought Staub's father, John Stilley, who said that though he understood what the possible sentence for Horton would be, he didn't agree with it.

“They can't just go out and do this and take people's lives like this, my son never did no harm to them. None,” he said.

Horton told Judge Stephen Bowers that her focus now is her family. Horton was pregnant when the shooting happened, and gave birth to a boy while she was in jail.

Horton had asked for probation instead, but it was denied.

Horton's guilty plea placed a cap on the number of years she would be sentenced. A criminal gang enhancement charge was also dropped with the guilty plea agreement.

From the audience, some family members yelled as they saw Horton leave the chamber.

“We love you, baby.”

Saylor is scheduled for sentencing July 30, while Terry's sentencing will be this Thursday. Heflin is scheduled for trial Aug. 20.
