SOUTH BEND — South Bend Police do not suspect any foul play in the death of an Elkhart man whose body was found following a one-vehicle accident Saturday morning.

Police initially considered the death of Maximino Colon, 36, of Jackson Boulevard, Elkhart, to be suspicious, but now believe his death was related to excessive partying or a health condition, said South Bend Police Capt. Phil Trent.

As of Monday, police don’t suspect foul play was involved in the man’s death.

Police responded to a single-car accident at about 7 a.m. in the 5200 block of South Miami Street on the south side of South Bend.

The driver of the GMC Yukon, Armando Johnson, 31, of South Bend, said he swerved to avoid another vehicle. His car left the road and struck a pole and a mailbox.

Police investigating the accident arrived and found the body of Colon in the back of the sport utility vehicle.

Johnson told police he thought Colon had fallen asleep after a long night of partying.

Trent described the accident as minor and not one that would typically result in a death.

Emergency responders were called to the scene and tried to resuscitate Colon, but declared him dead.

An autopsy on Colon was scheduled for Monday. If a toxicology test is sought, the results could take several weeks for results, Trent said.
