An Elkhart firefighter was arrested for public intoxication and operating while intoxicated Saturday night.

Matthew Rody, 48, was arrested around 7:45 p.m. at a 7-Eleven on 25014 C.R. 6, just south of the Toll Road, after police were called in reference to an intoxicated person at the store, according to the probable cause affidavit.

Police were told Rody was causing problems for the patrons and employees at the store. According to the affidavit, an unknown off-duty police officer took Rody’s keys and gave them to the store clerk. Rody was unable to give an adequate certified breath sample, and told police he had been drinking whiskey while watching the Notre Dame game.

He was booked at the Elkhart County Jail, and was released Sunday on a $1,500 bond.

The Elkhart County magistrate found probable cause of public intoxication, operating while intoxicated and operating while intoxicated, endangerment. However, formal charges are pending.

Rody was also arrested in 2005 for public intoxication. The case was dissmissed in 2006.
